*Demands N100 billion damages

Right Activist, Comrade Ighorhiohwunu Aghogho had urged the Ughelli Division High Court in Reliefs sought, to suspend Honorable Justice Ibrahim Tanko Mohammed from occupying the office of the Chief Justice of Nigeria/ Chairman National Judicial Council along with Honorable Justice Marshal Umukoro, the Chief Judge of Delta State, Honorable Justice Stella Ogene, the President Delta State Customary Court of Appeal, Harrison Attiene Esq, the Chairman Ughelli North Area Customary Court, Honorable S.P.J Emekpe , the 1st member Ughelli North Area Customary Court and Mr. Irherioma Christian , the Principal Registrar, Ughelli North Area Customary Court pending the hearing and determination of the substantive suit, a Fundamental Human Right Originating Summons filed on 23/3/2020.

In the said Suit/Court Process made available to Journalists in Warri , the Chief Justice of Nigeria and Chairman National Judicial Council(NJC) is the 2nd Respondent, the Chairman Code of Conduct Bureau is the 3rd Respondent, the Chief Judge of Delta State is the 4th Respondent , the President Delta State Customary Court of Appeal is the 5th Respondent , The Chairman, Ughelli North Area Customary Court is the 6th Respondent, the 1st Member Ughelli North Area Customary Court is the 7th Respondent, the 2nd Member Ughelli North Area Customary Court is the 8th Respondent and the Registrar Ughelli North Area Customary Court is the 9th Respondent amongst others.

In a 19 Paragraphs affidavit in support of the Motion on Notice deposed to by Comrade Ighorhiohwunu Aghogho, the Right Activist affirmed as follows:

“That I am the Plaintiff in this case and I am conversant with facts of the case”

“That the 2nd, 4th, 5th, 6th, 7th and 9th Respondents are among the judicial officers/workers who had been manipulating the Nation’s judicial system against the Plaintiff in all of his cases pending under the Delta State Judiciary prior this time.”

“That on/about 5th January 2019, the 4th Respondent in collaboration with the 2nd , 5th , 6th , 7th and 9th Respondents orchestrated an announcement on a radio station, Melody FM 88.6 Warri during the pendency of this case with suit number UNACC/384T/18 , shutting down the institution of the Applicant , Explosive Academy , occupying the accommodation described in the said judgment delivered by the 6th ,7th and 8th respondents dated 4/12/19 and further instigating all courts and Registrars under the Delta State Judiciary including 5th ,9th , 10th and 11th Respondents to prejudice the Applicant “

“That all Petitions including the Petitions dated 31/12/18, 7/1/19, 28/1/19, 16/2/19, 10/5/19 ,19/6/19, 9/7/19, 26/8/19, 25/9/19 and 30/9/19 respectively addressed to the 2nd Respondent by the Applicant was unlawfully investigated by the 4th, 5th , 6th , 7th and 9th Respondents and their agents who are subjects of the said Petitions.”

“That the Petitions including the Petitions dated 31/12/18, 7/1/19, 28/1/19, 16/2/19, 10/5/19 ,19/6/19, 9/7/19, 26/8/19, 25/9/19 and 30/9/19 respectively addressed to the 2nd Respondent were unlawfully investigated by the 4th Respondent who was among the subjects of the Petitions, dismissed and unlawfully published on the 2nd Respondent’s letter head dated 23/9/19 Reference numbers: NJC/DE. HC/10/II/96, NJC/DE. HC/10/II/94 respectively.”

“That there are Petitions dated 7/10/19 addressed to the 2nd Respondent for Re-investigation still pending and another dated 26/11/19 addressed to the 3rd Respondent for Re-investigation of the unlawful actions of the 4th Respondent of abusing his powers of investigating Petitions addressed to the 2nd Respondent where they (4th, 6th ,7th and 8th Respondents) are subjects when the 6th and 7th Respondents delivered Judgment dated 14/12/19 in the said case with suit number UNACC/384T/18.”

“That the 6th and 7th Respondents accepted the unlawful investigation report of the 2nd Respondent and presided over the case of the Applicant with suit number UNACC/384T/18, who is their accuser by acknowledging the receipt of a Petition written against their person/offices on alleged misconduct in a Judgment dated 4/12/19, they delivered”

“That the 6th, 7th, 8th and 9th Respondents were hired by the 2nd , 4th and 5th Respondents to prejudice the Applicant in court in the case with suit number UNACC/384T/18 pending at the Ughelli North Area Customary Court.”

“That 6th, 7th and 9th Respondents are acted unprofessional and unethical in performing their judicial functions.”

“That the 2nd, 4th ,5th Respondents are suspected law breakers, child thieves/ traffickers and corrupt judicial officers who will go to any length to pervert justice”.

“That the 2nd, 4th, 5th, 6th , 7th , 8th and 9th Respondents will exert overwhelming negative influence on this honorable court in order to prejudice the Applicant if this application is not granted.”

“That unless this honorable court suspends the 2nd, 4th , 5th ,6th , 7th and 9th Respondents as stated , they will continue to violate the Applicant’s fundamental human right to fair hearing and further subject him to all forms of torments.”

In the substantive suit filed on 23/3/2020, the Right Activist urged the court to restrained the Respondents whether by themselves, their agents, privies, and servants from taking steps in connection with the case with suit number UNACC/384T/18, stayed execution on the Judgement dated UNACC/384T/18, set aside the Judgement with suit number UNACC/384T/18 dated 4/12/19 delivered by the 6th , 7th and 8th Respondents, and grant an exemplary damage of N100Billion Naira against the Respondents, the court process stated.
